  Terms and Conditions

You Bid reserves the right to change these terms and conditions at anytime. You Bid requires all members to update their knowledge of the terms and conditions regularly as they may change  from time to time.
 
1. Definitions
  • "Admin Fee" means Administration and bidding fee.
  • "Agreement" means the terms  and conditions contained here in this agreement and our Privacy Policy.
  • "Auction" means a specific online auction format described in this agreement.
  • "Bid" means an offer (which has been accepted by You Bid) by a specific Bidder to pay a specific Bid Amount for a product or service in a You Bid Auction.
  • "Bid Amount" means the offer (in Australian Dollars) that a Bidder bids for a particular item in a You Bid Auction.
  • "Bid Increment" means the amount that is permitted by You Bid to separate possible Bid Amounts if and when applicable.
  • "Bidder" means a Member who has placed a specific Bid Amount (which has been accepted by You Bid) for a product or service in a You Bid Auction.
  • "Item" means one unit/package of a particular product/service on offer for a specific You Bid Auction.
  • "Lowest Unique Bid" means the lowest bid closest to zero dollars which is unmatched by any other Bidder.
  • "Member" means a natural person or legal entity that is not under any legal disability to enter into a legally binding contract
  • “You Bid” means You Bid, South Australian ABN: 80007042059
  • "You bid Auction" means the specific auction format described in this Agreement
  • "Required Number of Bids" means the number of Bids that are required in order to close/finish an auction.
  • "Successful Bidder" means the Bidder that is determined by You Bid to be offered the right to purchase a specific product/service on a You Bid Auction.
  • "End Date" means a specific date when You Bid will end an auction
  • "Website" meanswww.youbid.com.au
  • “$” means all amounts shown are in Australian Dollars
 
2.  Making a Bid
 
In order to make a bid, a bidder must be aged eighteen (18) years or older, and be a registered member of You Bid.
 
Members can place a Bid for a Product via Our Website and must submit their Bid in whole cents using the bidding form.  The Bid must not be in negative figures.  All Bids are sealed so that Bidders do not know what Bids have been offered by other Bidders.
All Bids are accepted to be in Australian cents and are inclusive of GST.
For each Bid placed a specified Administration Fee will be deducted from the members Account.  The Admin Fee charged per Bid is stipulated by You Bid at the start of an Auction and may be changed from time to time.
All Bidders acknowledge that once a Bid has been submitted, You Bid will deduct the Administration Fee from the Members Account
 
3.  The Bid Process
You Bid Member may place a bid on any of the Auctions in progress by clicking the Bid Now button on the Auction lot.
A Member who intends to commit to a bid will be charged the Admin Fee for placing each Bid on each Auction item which is payable at the time of submitting the bid from the Member account.
By placing a bid and paying the Admin Fee, the Member acknowledges that he or she understands how it works and agrees to the You Bid Terms and Conditions.
The Admin Fee is only refundable in the case of the relevant Auction being cancelled.  The Admin Fee and any deposits made to You Bid are non refundable.
The Bid Amount is the value of the bid that the Member submits and this amount is only payable by the Successful Bidder in the relevant Auction.
 
4.  Membership
 
4.1 Joining

Membership to You Bid is free. It is offered to residents of Australia and New Zealand over the age of eighteen.  Membership is available via the website. Applicants warrant the information they provide is true and correct.

4.2 Activating Your Account

After the Join Now form has been completed and submitted, an email will be sent to the email address specified on the Join Now Form. Applicants will be required to click on the activation link in this email. After this link has been activated the Members account will be active and ready for use. You are solely responsible for maintaining the confidentiality of any password and account.

4.3 Account Funds

Members intending to bid on an auction will be required to transfer funds to their Members Account for payment of the Admin Fee when placing a bid. A minimum of $10 and maximum of $250 is applied to Credit Card transactions. Funds can also be transferred directly into our account. Contact us for details. Funds cannot be transferred between You Bid Members Accounts.

4.4 Transfer of Funds

The Member warrants that they are the holder and authorized user of any credit cards and or accounts used for purchasing credit for their Member account.

4.5 Account Balances

Members may withdraw any remaining balance in their Member account by submitting a written request by email to You Bid. These funds will be transferred via PayPal or Electronic Fund Transfer. Administration fee is charged on all refunds.
Any credit in a Members account that has not been logged into at least once in a six month period will expire.

4.6 Cancellation of Membership

A Member may cancel their You Bid Membership at any time, provided they do not have any bids placed in an active Auction. Cancellation must be submitted by written request by email to You Bid. You Bid may cancel or suspend a Members Account if the Member breaches our Terms and Conditions
 
4.7 Termination of Bids

You Bid reserves the right to cancel any Bid without making a refund of the applicable Administrative Fee under any one or more of the following circumstances:

• If for any circumstance the Auction is not capable of running due to any reason (including but not limited to infection by computer virus, bugs, tampering, un authorized intervention, fraud, technical failures or any other causes), including anything which may corrupt the integrity or proper conduct of the Auction We reserve the right to cancel, terminate, modify or suspend the Auction

• You Bid reserves the right in its absolute discretion to cancel, withdraw, reject, suspend or bar a Bidder and their Bid at any stage during the Auction Period.

• Any other breach of these Terms and Condition
 
5.  Determinations of the Successful Bidder
 
The Bidder who has placed the Lowest Unique Bid will be deemed the Successful Bidder for the Product or Service on offer for that Auction.  The Lowest Unique Bid is the lowest value offered (in whole cents) for the Product or Service, which has not been offered by any other Bidder for that Product or Service.  If there is no lowest unique Bid, the Successful Bidder is determined by the lowest Bid amount with exactly two Bids.  The first Bidder to have placed the Bid is determined the winner.  If this does not produce a winner (if there is no Low Unique Bid with exactly two Bids the same) the process keeps repeating for the lowest Bid amount with exactly three Bids.  This will continue until a Successful Bidder is determined.
The Successful Bidder will be emailed or phoned at the end of the Auction Period and given the opportunity to accept or Reject the offer to purchase the Product or Service.
If the Successful Bidder Accepts the offer, the Successful Bidder will be required to pay for the Product at the price being the successful Bid rounded up to the nearest whole legal tender cent placed by the Bidder within 10 days of Accepting the offer. The Successful Bidder can pay by: requesting the amount be debited from their PayPal account, direct bank deposit or money order.
If the Successful Bidder Rejects the offer or fails to Accept the offer to purchase within 10 days of the Successful Bidder being notified of the Bid’s success or the Successful Bidder fails to pay for Product or Service within 10 days of accepting the offer, the Bidder will be deemed to have revoked the offer and will no longer be able to purchase the Product or Service
 
6.  Payment of the Processing Charge
 
The Member warrants that he/she is the owner of the credit/debit card and is authorised to make use of it for the purposes purchasing Credits for participating in You Bid Auctions.
Credit is purchased at a minimum amount of $10 and a maximum amount of $300 per transaction.
You Bid uses one or more third-party payment service providers for the acceptance of payments for You Bid Auctions, which are all selected for supreme security in mind, including the use of Secure Sockets Layer (SSL) for the transmission of sensitive information over the Internet and industry standard encryption for the storage of sensitive information as well as password and firewall access controls to this information.   You Bid will not be liable for any compromise or misuse of this information.
 
Once Credits have been purchased, then any refunds deemed due under these terms and conditions will be refunded in Credits to the Member’s Account.   You Bid will not make any cash refunds under any circumstances.
 
Neither purchased Credits or promotional Credits can be exchanged for cash or refunded.  They can only be used towards Administration Fees on You-bid Auctions.
In a case where You Bid offers a credit of Administration Fees, the Members Account will be credited with Credits to the amount due, and such Credits may then be used to offset Administration Fees on future You Bid auctions.
 
7.  Delivery & Supply of Auction Items
On receipt of payment from the Successful Bidder dispatch will take place within 7 days, unless otherwise stated.
Delivery is free of charge in Australia and at cost to New Zealand residents. Insurance is additional if requested by the Successful Bidder.
Setup and Installation costs are not included in the Bid amount, unless otherwise stated in the item description.
The delivery of the product and/or the service to the Successful Bidder is subject to payment in full of the Successful Unique Bid by the Successful Bidder, deducted from the Successful Bidders Member account.
 
It should be understood that You Bid is not the supplier of the products/services, and that the products/services may be supplied to Successful Bidders directly from the suppliers and/or the producers and/or the service providers, subject to the conditions stated in this agreement. All warranty claims must be taken up with the manufactures at the members expense.
 
You Bid is not liable for any wear & tear caused by improper handling or misuse by a member or by any third party.
 
Except to the extent that is required by law, You Bid is not responsible for the quality of the product, its fitness for purpose, its faults and/or unsuitability causing loss or damage to the user.
Where an advertised item is not available for any reason, You Bid will replace this item either with a newer model or another similar item of equal or greater value and quality.
 
8.  Data Protection and Privacy
 
You Bid acknowledges its duties under the Data Protection Act 1998 as a data controller.  You Bid will not sell personal Bidder information to any third-party, or use that information other than for the performance of this agreement without the express consent of the Bidder.
You Bid may however, disclose such personal information without consent if required to do so by law, or in response to a valid request from a law enforcement or governmental authority.
 
9.  Publicity
 
You Bid may, at its sole discretion, release any information concerning the status of a You Bid auction during the course of an auction.
Each Member acknowledges that, if he/she becomes the Successful Bidder, You Bid will be permitted to publicise his/her first name, and location (not their personal address), Bid, and the product /service, which was won in a relevant Auction.
 
You Bid may, at its discretion but is not obliged to, make the Bid of each individual Bidder, or any other information relating to a particular You Bid auction, publicly available after the Closing Date.
 
10.  Liability
 
You Bid shall not be liable for any failure to perform its obligations under this agreement caused by matters beyond its control.
You Bid shall not be liable to any Bidder or Successful Bidder for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this agreement or otherwise).
Nothing in this agreement limits You Bid liability for death or personal injury resulting from You Bid negligence, or any other liability, which may not by law be excluded.  Any statutory rights you may have as a consumer remain unaffected.
You bid excludes all and any liability whatsoever for any third-party advertising which may appear on this site or with respect to the contents of any third-party controlled website which may be accessed by means of any link from this site and gives no warranty or representation that any such links are virus-free or that the contents of any third-party website are accurate, complete, accessible in whole or in part or are fit for any particular purpose.
 
11.  Severance
 
If any provision of this agreement shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of this agreement, which shall remain in full force and effect.
 
12. How do I know that an email is really from You Bid?
 
If you receive an email that appears to be from You Bid that requests personal information, be cautious. The email may be a phishing email. People who send these fake emails hope that unsuspecting recipients will reply or click on a link in the email and provide personal information including passwords, bank account and credit card numbers.
Legitimate You Bid emails
You Bid will never ask you to provide account numbers, passwords or other confidential information through email. If You Bid does request information from you, a copy of that email will also appear in the My Messages section. If you have any doubt that an email is from You Bid, open a new web-page and type inwww.youbid.com.auand sign in. Any email that is not in my messages is a phishing (fake) email.
 
13. Restrictions on Bidding
 
Our employees, their immediate families, the Promoter’s employees and their immediate families are not permitted to bid.
 
The maximum number of Bids each Bidder can make in an Auction may be capped at the Promoters discretion.
